Product: The main product is passes for entrance into Partner Venues however PayAsUGym may from time to time sell other product as to which the following terms and conditions apply.
These terms and conditions govern your use of our website. Please read the terms in full before you use this Website. If you do not accept these terms, please do not use this Website. Using the Website implies that you accept these terms. We do occasionally update these terms so please refer back to them in the future.
PayAsUGym acts as Principal and as a Disclosed Agent for third party suppliers. When PayasUgym is acting as a Disclosed Agent this means is that the contract for the product is between you and the supplier. In most cases this will mean that there are additional terms and conditions governing the contract as each supplier will have terms and conditions relating to that product. Please make sure that you have read these terms and conditions before completing your transaction with us. Where we act as a Disclosed Agent, this will mean that we have no contractual liability to you in respect of that product. However, we may still be liable to you if we have been negligent, we have misrepresented important information or have been in breach of any other relevant law. On the other hand, for other Partners, we act as Principal. This means that the contract for the product is between you and us. We will always let you know where we act as Principal and where we act as a Disclosed Agent.
Customer Information collected by us is controlled by Sandcroft Avenue Limited (trading as ‘PayAsUGym’) with its registered office at 25.1 Coda Studios, 189 Munster Road, SW6 6AW.
Customer Information collected by PayAsUGym is stored on a central database hosted by our carefully selected third party provider in West Europe.
PayAsUGym collects Customer Information supplied by you and uses it to provide you with a dynamic, personalised and secure service to offer you a truly rewarding online experience. Although in certain instances, we will require you to provide us with your Personal Information, for example, to enable you to set up an account with us or purchase services (and we will make it clear to you at the time what we need from you), you can visit many pages on our website without the need to supply any Personal Information.
You provide us with your password and email address when you register an account on our website. The password used to register should be unique for PayAsUGym.
You provide us with your name, credit/debit card details, including card number, card type, cardholder name, expiry date, billing address and delivery details when you place an order through our website or other Distribution Channels.
Please note although PayAsUGymcollects credit/debit card details full financial information is not held by PayAsUGym.
Information from Competitions, Questionnaires and Surveys
When you complete questionnaires, surveys or competition entry forms you provide us with your Personal Information including your name, street address, email address and other information we might request.
When you contact us by email you may provide us with your Personal Information for example, name, email address etc.
Implicit data capture
Used to maintain something called session state. Session cookies are required for the website to function but are not used in any way to identify you personally.
When you visit our website, we will assign a permanent cookie on the hard drive of your computer. You can view these by looking in the cookies directory of your browser installation. As the name implies, permanent cookies last for a long time and each time you visit our website you send us a copy of them allowing us to identify you from visit to visit. For instance, if you were looking at gyms in London last time you were on the website and the next time you visit us we have a great gym promotion, this cookie enables us to recognise you, so that we can show you that deal. The aim is to enhance your experience whilst on the website and make sure you don’t miss out on great offers. Cookies do not contain any Personal Information for example, your name, address, email address, or telephone number, but simply a unique identification number that identifies your computer to us.
Third party tracking devices
Although you cannot block "session" cookies as they are required for our website to function correctly you can configure your Internet browser so that it can reject both "permanent" and "third party" cookies. How you do this will depend upon the Internet browser you use (for example, Internet Explorer 5, Netscape 4, Opera etc). Refer to the relevant Internet browser manufacturer's website where you should be able to receive all the information you need.

We may receive information about you from other sources, for example from credit reference agencies to guard against fraud or address, delivery information from third parties engaged for record correction purposes etc.

We will use the information that you provide to us when you register as a member on the website to set up and maintain Your Account.
When you place an order for services via the website or other Distribution Channels, we will use your purchase information to process the requested transaction, fulfil your order and provide you with the services you expect.
We may use your Customer Information to respond to your queries for example, about an order or problems logging on, navigating the website or accessing Your Account. In order to address your query, you may be contacted by email, over the telephone, or other communication method by a member of one of our customer services teams. We may also use your contact details to send you follow up information about a purchase. We may contact you via email, phone or other communication channel to respond to suggestions you may send to us (for example about our website, products and services) and to assess and announce the results of surveys, competitions and other contests you may have participated in. For quality assurance and training reasons we record most of our telephone calls with our customers. Some information including customer e-mails received by PayAsUGym may be used by us for testimonials though your Personal Information, such as e-mail address or contact details, will never be displayed publicly by us.
We use the information gathered from your permanent cookie file (see Cookies above) in conjunction with other Customer Information provided by you, so that we can create a more effective website by assessing content and traffic flows on the site. We use this information to provide you with a more personalised experience on the website, help you to navigate the site effortlessly and to display particular products and services that we believe may be of interest to you.
When you register Your Account or place an order via our website or other Distribution Channel, we may use your Customer Information to contact you with details of special offers, promotions and other information and to send you our newsletters where we think these will be of interest. You can change your preferences and unsubscribe for such communications at any time by visiting Your Account section of the website or by using the unsubscribe link at the bottom of emails you receive from us.

PayAsUGym engages carefully selected third party partners, including service providers, joint venture partners and outsource providers to perform various functions on our behalf. To the extent required to perform such functions on our behalf, these companies may process your Customer Information. Such functions include, processing purchases and providing associated information, delivering products and services, processing credit card payments, providing search results, communicating with you, including providing customer service, via telephone, email, post or otherwise and for promotional activities.
We may also share your Customer Information with third parties for the purpose of data analysis, quality assurance (including fraud prevention).
Third party vendors, including Google, show PayAsUGym ads on sites on the internet.
Like any other organisation, from time to time PayAsUGym may restructure its business operations by selling one or more of its businesses (or part of a business). In such transactions, your Customer Information could be transferred as part of the relevant sale. If this is the case, we would contact you to let you know.
We may disclose your Personal Information to third parties, such as official bodies and our professional advisers, as far as we believe necessary (i) to comply with relevant laws, orders or regulations, (ii) to enforce our customer terms and conditions of use or other contractual agreements and (iii) to protect the property and other rights of PayAsUGym, its group companies, customers and others (for example, in any way relating to protection against fraudulent activities.
In the UK we operate and are registered in accordance with applicable UK data protection legislation.
We use leading technological and security measures (electronic, physical and procedural) to ensure the safety and confidentiality of your Customer Information through collection , storage and disclosure. Such measures include maintaining a secure encryption based transmission system, intrusion detection and prevention software and virus protection software in respect of Customer Information.
PayAsUGym understands that it is important that you have control over your Customer Information.
You can view and change My Account settings and information, including your contact email address by visiting the ‘My Details’ section in My Account on the website. In particular, if you do not want to receive special offers and promotional communications from PayAsUGym you can set your preferences to opt out via My Account or by using the unsubscribe link at the bottom of emails you receive from us.
You will be able to access the majority of this Website without having to register any details with us. However, particular areas of this Website will only be accessible only if you have registered.
You are permitted to use our website for your own purposes and to print and download material from this Website provided that you do not modify any content without our consent. Material on this website must not be republished online or offline without our permission.

Customer are allowed to create one account only on PayAsUGym. We reserve the right to close all the accounts of any user that is suspected of creating multiple account to take advantage of promotions or referral offers.
We take all reasonable steps to ensure that this Website is available 24 hours every day, 365 days per year. However, websites do sometimes encounter downtime due to server and, other technical issues. Therefore we will not be liable if this website is unavailable at any time.
This Website may be temporarily unavailable due to issues such as system failure, maintenance or repair or for reasons beyond our control. Where possible we will try to give our visitors advance warning of maintenance issues but shall not be obliged to do so.

We reserve the right to permanently suspend any user on the grounds of behaviour that we or our Partners, in good faith, deem at our mutual or sole discretion to be threatening, abusive or antisocial in any way. We operate a 'banned from one, banned from all policy' whereby if you are permanently suspended from one venue within the PayAsUGym network you may be banned from all.
Please also note that whenever you present your Pass Code for redemption at a venue you are agreeing to accept and abide by the terms and conditions of use governing that venue (which can be requested from the venue on arrival as required). Therefore any breach of venue-specific terms and conditions may result in a ban from all venues on the PayAsUGym platform.
We will always respect our Partners right to refuse entry to any guest who does not comply with their terms and conditions.
Any links to third party websites located on this Website are provided for your convenience only. We have not reviewed each third party website and have no responsibility for such third party websites or their content. We do not endorse the third party websites or make representations about them or any material contained in them. If you choose to access a third party website linked to from this Website, it is at your own risk.

When you exchange a pass for entrance to any of our Partner’s premises within the PayAsUGym programme, PayAsUGym, its officers, agents and/or consultants have no liability whatsoever in contract, tort, or otherwise for your acts, omissions or opinions and is in no way responsible for the behaviour or within any of the Partner’s premises. This means that PayasUgym is in no way liable or responsible for your health and safety at any time.
Neither we nor any other party (whether or not involved in producing, maintaining or delivering this Website), shall be liability or responsible for any kind of loss or damage that may result to you or a third party as a result of your or their use of our website. This exclusion shall include servicing or repair costs and, without limitation, any other direct, indirect or consequential loss, and whether in tort or contract or otherwise in connection with this Website.
Nothing in these Terms shall exclude or limit liability for (i) death or personal injury caused by negligence (as defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under the law of the United Kingdom.
A ' Pass Code ' is a unique numeric code purchased by you and only applies to and is valid to be redeemed at ‘Partner Venues’ for entrance to their facilities. On arrival you will be required to present your Pass Code for redemption and in doing so you agree to accept and abide by the terms & conditions of use governing that venue which can be requested from the venue on arrival as required.
Please note that we recommend all of our gym Partners request that you provide them with proof of identity on arrival at the gym in order to ensure you are the purchaser of the Pass Code. Acceptable forms of identification typically include passport, driving licence, ID card etc. However, please read the venue description carefully as a small number of venues will insist on photographic ID only. Where this is the case we include a note to this effect on the venue description.
Please note that each Pass Code you purchase will only grant you access to a venue. You may not share your codes with others, or purchase codes on behalf of someone else. If you cannot provide ID which matches the Pass Code purchaser details then you will be prevented from accessing venues.
When using PayAsUGym services, you also shall be subject to any posted guidelines, FAQs, or rules applicable to such services, which may be posted and modified from time to time.
DAY PASS. All One Day Passes are valid for one single entrance to the gym it was purchased for, and can be used within a period of 30 days. If a pass is not used within the 30 day validity period the pass will be invalid and you will lose the value, this pass will be marked ‘Expired’ in the ‘My Account’ section. You may refund an unused One Day Pass at any point during its 30 day validity period. Refunds for One Day Passes are in the form of bonus credit, which can be used to purchase any of the products on our website, and will be valid for 30 days from the date of the refund. Once used, a One Day Pass may not be refunded.
A One Day Pass purchased with bonus credit can be refunded, however the bonus credit will only be credited back into the account if it is valid and has not expired during the period while the pass was not used. A One Day Pass purchased with a ‘First Pass Free’ promotion can be cancelled but no funds will be transferred back into the registered user’s account.
BUNDLES OF DAY PASSES . Bundle products are multiple single use passes which are sold at a discounted price than the corresponding individual pass. A 5 Day Pass will give the user access to the venue the pass was purchased for for 5 times within the 30 day validity period. A 10 Day Pass will give the user access to the venue the pass was purchased for 10 times within the 60 day validity period. Unused bundle products are refundable within 14 days of purchase through Customer Service. Bundle products will not be refunded once they have been used. In the exceptional circumstance that a venue closes down before the entire pass has been used, the user will be refunded for their remaining visits, at the discounted price that the passes were purchased for.
30 AND 90 DAY PASSES. 30 Day and 90 Day Passes are valid for an unlimited number of entries to the club that they have been purchased for. 30 and 90 Day Passes are only valid for the individual who has purchased them. 30 Day Passes are valid for 30 days from the selected start date. 90 Day Passes are valid for 90 days from the selected start date. Unused 30 and 90 Day Passes are refundable within 14 days of purchase. Refunds for unused 30 and 90 Day Passes are in cash, which may be withdrawn from your PayAsUGym account, subject to a £1 transaction fee.
CLASSES. As-You-Go Classes can be cancelled 12 hours before the start of the class. This will be refunded to your PayAsUGym account as bonus credit. You will be unable to cancel within 12 hours of the start time of the class, and you will not receive a refund for the booked class if you're unable to attend.
We take all reasonable measures to ensure that the class timetables on PayAsUGym are up-to-date. There may be some occasions where the information that we have on the website has not been updated. In these instances, a refund will be processed in the form of credit by which the pass was originally purchased.
Monthly passes are valid for an uncapped number of entries to the club that they have been purchased for. All monthly passes are valid only for the individual who has purchased them. A maximum of 50% of the total payment for any Monthly Pass can be made using bonus credit.
RECURRING BILLING OF MONTHLY PASSES . All Monthly Passes will be billed monthly, on the same date each month. By starting your Monthly Pass you authorise us to charge you a monthly membership fee, the 'Monthly Renewal Payment', at the then current rate. A maximum of 50% bonus credit can be applied for recurring monthly payments.
PAYMENT METHODS FOR MONTHLY PASSES . You may edit your payment method information at any time by logging into your account or by contacting Customer Service. If an applicable payment is not successfully settled, for any reason, you remain responsible for any uncollected amounts.
CANCELLATION OF MONTHLY PASSES (outside of initial 14-day membership period). Monthly Passes with a minimum period of 1 month can be cancelled at any time after the first 14 days after the first purchase (where the first purchase counts only as the initial Monthly payment, not a renewal payment) to prevent the next Monthly Renewal Payment from being billed. The user will be able to use the Pass until the end of their current monthly billing cycle once cancelled. UNLESS EXPRESSLY STATED TO THE CONTRARY HEREIN, OR AS PROVIDED BY APPLICABLE LAW, PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members. The amount and form of such refunds or discounts and the decision to provide them, are at PayAsUGym's sole and absolute discretion.
RIGHT TO CANCEL WITHIN 14 DAYS OF PURCHASE FOR MONTHLY PASSES. The user has the right to cancel their Monthly Pass within 14 days of the initial sign up date (where the initial sign up date is the date of the first Monthly payment, not a renewal payment) without giving any reason. The user can cancel the membership through their PayAsUGym or by contacting Customer Service. An Admin fee will be charged if the Pass has been used within the initial 14 days, calculated using the day pass price of the venue that the user has purchased the pass for, multiplied by the number of visits made to any venue prior to cancellation. We may at our own discretion waive any fees incurred. We will make any reimbursements no later than 14 days after the day on which we are informed about your decision to cancel your membership.
ACCESS TO OTHER VENUES WITH A MONTHLY PASS. With a Monthly Pass, the user will be able to access all of the gyms which offer their own Monthly Pass, where the monthly renewal price is less or equivalent to the one of the primary chosen venue. Access to venues may vary depending on price changes to the monthly pass price. A list of available venues that you can visit with your Monthly Pass will be available in your PayAsUGym account when logged in.
You have to be aged 16 years or above to purchase a pass. However some of our Partners allow parents and other legal guardians to purchase passes to be used at Partner gyms for children under 16 in their care. This is most likely to be the case for Local Leisure Centre facilities where swimming passes are available. As it is entirely under the discretion of the gym you are advised to check with the Partner that you intend to visit if you would like to purchase a pass for children less than 16 years of age. Some of our Partners do require customers to be at least 18 years of age in order to purchase a pass, this will be made clear at time of booking.
We do from time to time, we make vouchers and discounts available through affiliate websites or email promotions. Where applicable, the expiry date and validity period of a voucher or discount will be stated in any communications from us. We cannot guarantee the validity of voucher codes or discounts on websites not endorsed by ourselves. Vouchers and discounts will vary in their validity of use towards different passes.
Vouchers and discounts cannot be used in conjunction with one another, unless explicitly stated – where a second voucher is applied to an account, the original voucher will be overwritten and its discount will be lost. Vouchers are non-transferrable and have no cash value. Placing a voucher for sale is strictly prohibited and will ensue in the voucher being made void.
To redeem a voucher, you must present the code at checkout, or through the voucher section of ‘My Account’ prior to checkout. Where the voucher, discount or promotion takes the form of bonus credit (including bonus credit received in return for leaving feedback), unless otherwise stated, once added to an account the bonus credit will be valid for 30 days.
PayAsUGym reserves the right to reject a voucher with reasonable cause, and to withdraw any offer at any time without warning.
If an existing customer refers a new customer using the referral system available through ‘My Account’, we will give the referrer £10 bonus credit. The voucher code for this will be sent via email, and should be redeemed either through the voucher redemption or checkout page. The referred customer will receive 50% off their first PayAsUGym order, provided that they have added their voucher during the checkout process. Before either of the above vouchers are applied to an account, they will be valid for 3 months from date of issue. Once the voucher has been applied, the discount or credit will be valid on the account for 30 days.
Only new customers can be referred using the referral scheme. To qualify, a user must have registered less than 3 days ago, and have taken no actions on their account.
The existing customer will only receive their referral voucher once the referred friend has completed a successful transaction.
Referral vouchers cannot be used in conjunction with any other customer offer or promotion.
Customer are allowed to create one account only on PayAsUGym. We reserve the right to close all the accounts of any user that is suspected of creating multiple account to take advantage of promotions or referral offers.
We incentivise users to leave feedback for their gym visits. Feedback must be useful, original, and inoffensive to be approved. If it does not meet this criteria, or for any other reason we do not think that it should be made available on the website, PayAsUGym may reject the feedback and this will not count towards your feedback bonus credit. For each 5 pieces of approved feedback, the user will receive £5 bonus credit. This credit will be valid on a user's account for 30 days once applied.
You will be notified via email if your feedback has been rejected, and you will have the opportunity to leave any rejected feedback again.
Feedback will be processed within 3 days of it being left by the user. If it is not showing on the website within this time, it might have been sent to the Partner to request their response. We give partners 3 days to respond to feedback, before it automatically is set to live on the website.
The visits available to leave feedback for will be visible in a user’s account. Feedback can be left for every visit with a Day Pass, and every first, fifth, tenth visit etc per venue with a FitFix 5, FitFix 10 or Monthly Pass.
PayAsUGym reserves the right to change or remove this promotion at any time, without notification.
